سپریم کورٹ اور جمہوری حکومت کی بحالی

پڑھا لکھا پنجاب یعنی جناب چودھری پرویز الٰہی کی جانب سے شروع کیا جانے والا حکومت پنجاب کا چار ہزار ایکڑ پر محیط نیو مری پروجیکٹ پاکستان کی ماحولیاتی آلودگی میں بے پناہ اضافہ کر سکتا تھا مگر اس کے پیچھے قارون پاکستان جناب ملک ریاض صاحب کا ہاتھ تھا جنہیں فرعون پاکستان جناب مشرف صاحب اور انکے درباری جرنیلوں کا آشیرباد بھی حاصل تھا -جرنیلوں کو بحریہ ٹاؤن اور ڈی ایچ اے کے تجربے سے رئیل اسٹیٹ کے بزنس کی لگی لت اس ماحولیاتی دہشت گردی کے منصوبہ کے پایہ تکمیل تک پہنچنے کی ضمانت تھی- اگر سپریم کورٹ کا سوموٹو نوٹس ہرکولیس کے ہتھوڑے کی طرح پاکستان کے طاقتور ترین افراد کے مال بنانے کے خواب پر برس نہ پڑتا تو بنیادی سہولیات سے محروم عوام صاف فضا میں سانس لینے کے بنیادی حق سے بھی محروم ہوجاتی
پاکستانیوں کو ڈالروں کے عوص امریکہ کو بیچنے کا اعتراف کرنے والے فوجی سربراہ جرنل مشرف اور اس انسانی بیو پار میں شریک جرم دیگر افسران کے لئے لاپتہ افراد کی بازیابی کے لئے سپریم کورٹ کا سوموٹو نوٹس اور اس سلسلہ میں ملوث اداروں پر بازیابی کے لئے دبائو ناقابل قبول تھا- ایسی صورت حال میں سول سپریم کورٹ پر فوجی بالادستی قائم کرنا فوج کی اعلٰی قیادت کی دانست میں ناگزیر تھا- اسی بلا دستی کو قائم کرنے کی ضد میں جرنل مشرف نے فوج کے پانچ اہم جرنیلوں جن میں اس وقت کے آئی ایس آئی چیف جناب اشفاق پرویز کیانی بھی شامل تھے کے ہمراہ سپریم کورٹ کے چیف جسٹس جناب چودھری افتخار کو آرمی ہاؤس بلا کر استعفیٰ کا مطالبہ کر دیا - جو واضح طور پر فوج کی طرف سے ایک سول ادارے کو اپنی بالادستی کا پیغام تھا- چیف جسٹس چودھری افتخار نے فوجی سربراہ کا حکم ماننے سے صاف انکار کر دیا وہ انکار جس نے آزاد عدلیہ تحریک کا روپ دھار لیا اور ملک میں قائم سیاسی جمود کو توڑ دیا-اپنے آمرانہ طرز حکومت کے باعث عوام میں غیر مقبول مشرف حکومت کے سپریم کورٹ پر حملے کے جواب میں عدلیہ تحریک سے آمریت لڑ کھڑا اٹھی- اپنے اقتدار کے لئے سیاسی جماعتوں کو زہر مہلک سمجھنے والی آمریت سنبھلنے کی کوشش میں پیپلز پارٹی سے شراکت اقتدار پر آمادہ ہوگئی - جس کے نتیجہ میں پیپلز پارٹی کی چیرُیرسن محترمہ بینظیر بھٹو کی وطن واپسی ممکن ہوئی جو بہرحال آگے چل کر 2008 میں فوج سے عوام کو اقتدار کی منتقلی کا اہم جز ثابت ہوئی١٩٩٩ سے جاری دور آمریت کے مظالم کو ایک اور ظلم سے چھپانے کے لئے بدنام زمانہ قومی مفاہمتی آرڈیننس این-آر-او جاری کیا گیا جس میں آٹھ ہزار کے قریب ملزموں کو بغیر کسی صفائی کے باعزت بری کیا گیا -آرڈیننس کو عوامی حلقوں نے ماننے اس انکار کر دیا یہاں تک کے پارلیمان میں اکثریتی جماعت پیپلز پارٹی نے اسے ایوان میں پیش کرنے سے گریز کیا - انہی عوامی جذبات کی ترجمانی کرتے ہوئے ٢٠٠٧ میں سپریم کورٹ نے پہلے اس آرڈیننس کو معطل اور بعد میں ٢٠٠٩ میں کالعدم قرار دیا
٢٠١٢ میں جب فوج نے اقتدار پر قبضہ کے لئے جناب طاہر القادری کی شکل میں ایک ٹروجن ہارس پاکستان کے سیاسی میدان میں اتار تو عوامی حکومت سے جاری فوجی کشمکش نے ایک دلچسپ صورت حال اختیار کر لی تاہم طاہر القادری کےایجنڈے کو عدالتی فیصلہ نے غیر موثر کر دیا- مصر میں فوج کے ہاتھوں مرسی حکومت کا خاتمہ اسی ایجنڈے کی ایک کامیاب مثال ہے جسےپاکستان میں سپریم کورٹ نے ناکام بنا کر سول حکومت کا تحفظ کیافوج اور سول عوام کے درمیان اقتدار کی کشمکش جاری رہے گی -١٩٧٧ کے انتخابات کے بعد اسٹبلشمنٹ کے من پسند اتحاد پی-این-اے کی شکست کے بعد دھاندلی کے نام پر سول حکومت کے خلاف مظاہروں کی سازشی سیاست جیسے حربے آج بھی آزمائے جا رہے ہیں تاہم سپریم کورٹ نے بھی دھاندلی کا ڈھول پیٹنے والوں کو عدالت میں طلب کر لیا ہے اور امید ہے کے طاہر القادری کے ایجنڈے کی طرح اس ایجنڈے کو بھی عوام کے سامنے غلط ثابت کر دے گی

My Advice To Imran Khan PTI

Let me be very candid and fair, Imran Khan PTI contempt notice was un-called for, completely unexpected and unwarranted, in fact it shocked many. Yes Imran Khan is very vocal against rigging in GE2013, the role of ECP and Courts. But to be fair to courts, ECP is an independent institution after 18 amendment, very powerful one as well, the Imran criticizing Supreme Court just doesn't sound right and just as well. His criticism of ECP may have reasons, justifications that are understandable but what the Supreme Court had to do with it is not understandable. Now let us not indulge into who is right and who is not, let's just focus on why i do feel Imran Should tender an unconditional apology to the court and make himself a True Democratic leader, true voice of his followers. As "Abraham Lincoln" once said... "In Great Contests Each Party Claims To Act In Accordance With The Will Of The God, Both May Be, and one must be wrong".Now let me explain why Imran Khan needs to tender an unconditional apology that would lead to a rise in his stature.
1) Imran Khan by tendering an apology can immediately take a psychological edge over its main rival PMLN, as their history regarding contempt notices is not very beaming and not worthy. As we all remember PMLN stormed the Justice Sajjad Ali Shah courts after their leader Nawaz Sharif ( Then PM ) was served with contempt notice, yes Sajjad Ali Shah was very controversial, was working at the behest of the then President Farooq Ahmad Leghari to throw out a Democratically Elected Government but history remembered the images of PMLN workers and Leaders storming in the Supreme Court building. PMLN leaders still taunted by their rivals of that unwanted decision made in haste, literally a black spot on the glaring political struggle of Mian Nawaz Sharif.
2) Imran Khan's stance doesn't sound convincing when he talks that the Supreme Court must intervene, take a sou moto if I am getting it right regarding his claims of rigging. Imran Khan must realize that after 18 amendments ECP is a very powerful institution they showed their muscle during the GE, when many decisions made by care takers were reversed by them, so it would have made two institutions SC and ECP at loggerheads with each other because Fakhr ud Din G Ibrahim always maintained that GE 2013 were one of the fairest in the history of Pakistan, his claims got an endorsement from Local and International observers as well. Secondly Imran Khan not even once Questioned ECP before the GE 2013, their placing of officers ( RO ) in different constituencies, similarly neither presiding officers were questioned till the results started coming on 11 May, even then Asad Umar appeared on the National Television , congratulated PMLN's victory. Finally Imran Khan himself confessed publicly and apologizing publicly regarding awarding of tickets in GE and Intra-Party polls.
3) Imran Khan seemingly endorsing PPP point of view regarding rigging in GE and Superior courts favouring the one party, the same PPP which got thrashing of a life time during the Polls, remiained at loggers head with SC regarding their Hundreds of billions rupees of loot and plunder, the same PPP which got reduced to from a Federal party to a Provincial party due to their poor governance, their Two former Prime Ministers facing jail in coming days, hundreds of billions of corruption cases pending in Supreme court, Nab and FIA, their President fearing of opening of Swiss cases once Presidential immunity is stripped off, their leaders openly mailgning the superior courts due to their hidden agenda. Imran Khan toeing their policies is simply mind boggling and wouldn't send the right signals to his voters and supporters.
4) Imran Khan PTI gets second highest votes in General Elections close to 7.5 million, becoming the second largest party in Pakistan, wiping PPP off from Punjab and KPK, forming a Government in KPK, winning a sizeable number of NA seats, getting their opposition leader placed in Punjab, Imran Khan gets huge applause in the Print and Electronic Media, dominating the Social Media. There is no doubt in my mind Imran Khan PTI is a government in waiting unless PMLN performs exceptionally and PTI performs badly in KPK because Imran Khan got a golden opportunity to make institutions and his agenda implemented in KPK, he must remember his performance now must be compared with other Provinces, glaring mistakes like D I Khan jail break will come to haunt him in coming Polls in 2018. With his performance he can give PMLN run for their money in coming GE or his party PTI may face the same fate as PPP.
5) Imran Khan's recent decision of contesting Presidential Polls despite being pursued by many to boycott the Polls won his laurels and high moral ground in Democratic circles, elevated him to the status of the main Opposition Party because PPP committed a blunder boycotting the Polls handing over the initiative to Imran Khan PTI which he grabbed with both hands. Imran Khan PTI can achieve towering and prominent stature by appearing in court, humbly submit his unconditional apology and take a much honorable route of constitutional and legal struggle against his claims of rigging in GE 2013. He should knock every door, take a difficult but logical course of his political struggle, believe me Imran Khan immediately will lift his stature as a leader, he will immediately get that moral superiority to his rivals because there are already many conspiracy theories and stories circulating in the market that this clash might derail Democracy once again, this will only result Imran Khan is being the net loser, PPP and PMLN winner, will revive PPP's dying politics.
Hope common sense will prevail at both ends, Imran Khan learn from history and courts as well learn from their past which unfortunately is not the one to talk about. Let me end this read with "Abraham Lincoln" Quote "I Do Not Think Much Of A Man Who Is Not Wiser Today Than He Was Yesterday".

Many in this country of pure consider "Asif Ali Zardari", one of the most shrewd politicians this country ever witnessed in it's 65 year history, despite taking this country's economy to its historic low, setting new records of corruption and nepotism but his admirer are of the view that he helped or rather i should say tried for Federation Of Pakistan, successfully removing Mushraf from Presidency and placing himself in Presidency considered on of his greatest victory and master strokes, completing his five year tenure again considered his accomplishment as are much trumped PPP amendments in constitutions. But now the question arises, are these so called PPP achievements and attainments were possible without the help of a steady and mature opposition done by PMLN Nawaz Sharif??. Infect at the end of the day these mistakes cost PPP the GE 2013 and limited them to Interior Sindh hence a regional party from a Federating one.
Zardari Sahib seems on a suicidal mission, here I completely agree with many that even Dictators not able to conquer the courage of Jiyalas neither they were able to dent PPP fort but Zardari Sahib with his miraculous politics better known to him has literally forced PPP back to the wall. PPP latest decision to Boycott the Presidential Election's may seem the last nail in PPP coffin, as it has ousted PPP from Democratic process, at the same time given room to Imran Khan to establish himself a very seasoned and mature politician, a missing link in Kaptaan's politics or maybe he too was waiting the right moment. Secondly PPP was trying to make a comeback in politics with a bang with the mere perception that MQM will side them and maybe Imran Khan will follow them in boycotting the Presidential Elections. PPP is forgetting the very fact they had nothing to offer to MQM as PPP is not in Power in Federal Government, secondly Zardari Sahb about to lose his Presidency as final numbers tell us after the Presidential Elections even if MQM boycotted the elections "Mamnoon Hussain" would have won easily and convincingly. PPP may have thought that MQM and PMLN differences are like the Himalayas, not bridgeable but forgetting that during their own reign when MQM would leave the Government every second day and rejoin them even more quickly. Altaf Bahi right now needs Federal Government more than the provincial one as pending inquiry in Scotland Yard regarding Imran Farooq Murder and Money Laundering probe resulting from that murder inquiry, British Media too exerting tremendous pressure on the British Government to move on with the case, take it to its logical end. |

Media reports suggest that high level delegations visited PTI Imran Khan to convince him to boycott Presidential Elections but Imran Khan despite showing his reservations, participating in the Democratic process, leaving PPP in the lurch and in no mans land. Infect Shah Mehmood Quershi responding to their request by asking them to support PTI candidate and not to boycott the Elections. Definitely Imran Khan has emerged as an Opposition leader, shifting lime light from PPP to PTI.
Now question arises what made PPP to boycott the Elections, make them controversial if we look at the candidate "Mamnoon Hussain' a very humble and down to earth guy with a political history of standing against a Dictator, belonging to a middle class family, an IBA graduate, after decades when a Middle Class self made guy equally respected by all political parties enjoying a very good reputation in Media, above all a Sindhi and Urdu Speaking about to make it to Presidency, why make him controversial ??.
PPP's animosity against the Supreme Court of Pakistan not hidden from anyone, PPP think they were dealt harshly and heavy handed by the Honorable Courts but Courts think otherwise that that they are doing their job according to the Constitution. Latest decision where Supreme Court allows Presidential Election Date to moved back irked PPP, they think their plea not listened, they are not given enough time to canvass for the Elections but final results of the Presidential Elections clearly show PMLN candidate won overwhelmingly, it wouldn't have made any difference to his final tally of votes. So why this bitterness and displeasure shown by PPP??.
PPP going through their historic low due to their own deeds and faults, Imran Khan contrary to popular belief has become a threat to PPP existence as shown by last GE, PMLN retained and able to get all the Muslim League and most of the right wing vote, while Imran Khan dented PPP vote bank in addition to his youth vote, so PPP needs to up the anti, had to prove themselves the real opposition, get Media attention which clearly tilting towards PTI as an opposition party. PPP miscalculating that MQM and PMLN are poles apart, never meant for each other, but PMLN swallowing the bitter pill to legitimize Presidential Election because with MQM and PPP boycotting the Elections, PMLN wouldn't be able to legitimize the Presidential Election as main stream parties from Sindh boycotted the Polls, so at the end of the day it seems a marriage of convenience where both parties taking something home. PPP were too scared that they might get exposed in the Senate and Sindh Assembly, reports already in press that strong group's inside PPP ranks revolting against PPP decision makers ( Asif Ali Zardari ). Finally PPP thought that it's the right time to launch a full scale assault against Supreme Court as since new Government has taken over particularly Interior Ministry ( FIA ) under Ch Nisar has expedited the pending corruption cases against PPP big wigs. Two former Prime Minister's about to be arrested any time in billions of rupees corruption charges, many other former Federal Ministers and PPP cronies under the FIA radar. Most importantly as President Asif Ali Zardari about to leave the Presidency with it that Constitutional immunity gone as well, the old witch of Swiss Cases about to haunt PPP again. This Presidential Boycott was a mere smokescreen to launch an assault on Courts, making them controversial, terming them Pro PMLN so decisions against PPP become controversial. ( We already have seen, the Supreme Court has started tightening screws on this Government as well, as Aviation Minister made to resign on Dual Nationality, Chairman PIA also made to resign as was appointed violating earlier Supreme court judgement).

So PPP makes a grave mistake, maybe a final nail in their great political struggle, making decisions in haste, they must remember their historic struggle for Democracy, as BB once boycotted Elections under Zia's Rule she ruined that decisions years to come. Similarly PPP took part in the 2007 Presidential Elections despite all the reservations of theirs. As Democratic forces thrive upon Democratic norms and process, we have seen that during the Presidential Elections PPP is going to back burners, PTI candidate Justice Waji u Din taking all the Lime Light. PPP from now on must take each and every step very carefully and wisely because time is running out for them, there is no Zulifiqar Ali Bhatto and Benazir Bhatto to bank on.
NOTE Democracy always thrived and remained un-harmed under the Presidency of Ch Fazal Allahi, the likes of Rafique Tarar, But always remained controversial when occupied by Dictators Gen Zia, Gen Yahya Khan or Democratically Elected but Powerful Presidents like Ghulam Ishaq Khan, Farooq Leghari, Asif Zardari.
